New Delhi: Nirbhaya gang rape final judgment has arrived. The Supreme Court has upheld the death sentence and fine against the four accused. The four has been held responsible for the rape and murder of 23-year old Jyoti Singh, who has been known as Nirbhaya following her death.
The four convicts had approached the apex court against a lower court order sentencing them to death and imposing heavy fines against them. A teenager boy who was also part of the rapists and killers was not the part of the case and he has been given benefit for his being juvenile.
Supreme Court called the incident as rarest of the rare. This is notwithstanding the case that similar cases are observed almost on a daily basis in different parts of the country. In Delhi alone at least half of dozen cases of rape are observed on daily basis. Still worst is the case of very young children who are routinely sexually abused in different parts of the country.
“The Nirbhaya rape-cum-murder case is rarest of rare case and we are compelled to give extreme punishment to ensure justice”, the apex court said while delivering the judgment. It should be kept in mind that the apex court was hearing an appeal filed by the four convicts – Akshay, Pawan, Vinay Sharma and Mukesh – who challenged the Delhi High Court’s March 2014 confirmation of the death sentence handed to them by a trial court in 2013.
The court commended the Delhi police for its investigation in the cse. The investigations done by Delhi Police was fair and impartial and the probe has passed the test of fairness and reliability…The dying declaration of Nirbhaya is reliable as it was corroborated by medical and other evidences” the court said.
In the meantime convicts’ lawyer has called the sentence as the murder of justice. “You can’t hang someone just to send a message to society. Human rights have been slaughtered today…Justice is not done, we will file a review petition after reading the order”, convicts lawyer AP Singh said.
