Female Muslim lawyer condemns Govt. interference in Muslim personal law

Every other day TV channels in India sit down to debate TRIPLE TALAQ. The issue is genuine concern for half of Muslim population but the way it is being treated these days show sullied intentions of whoever wants these TV channels to stereotype Muslims as most regressive of Indians.

These channels make some people play to their tunes by running hashtags. A couple of days ago ‘Times Now’ and its ‘supreme judge’ ran the hashtag #OneNationOneLaw. You must read the tweets to see joy of hypocrites in showing Muslims as only drag on the country’s transformation from a backward to a progressive society. By the way it is still on with same topic today too.

India is just 69 yrs old and needs reforms in all sections and communities. It should be done with genuine intention and not as bully by majoritarian. The kind of red herring being created, fears of Muslims are not unfounded as MSM is being used to stereotype Muslims as regressive and only community in need of reform.

Unilateral right of man to divorce a woman creates control power in favour of man to abandon, dump & trample woman and her self respect. Yes triple talaq is being politicised to demean Muslim community in general, but were not Muslim-women demeaned with triple & unilateral talaq. Whether Hindus need reforms or not, lets face it, Muslim women have been cheated by their own men who are unwilling to let go privilige they have.

Muslim Personal Law Board agreed to codify MPL in 1995, till date they have done nothing. Now when state steps to interfere there is a hue and cry. Having said that, religion is all about staunch belief. Even if state bans triple talaq and men indulge in it, socially, will the marriage exist?

There is no clear draft or plan either with community or with state as to how they will deter triple talaq. This requires lot of social engineering.

Banning Triple Talaq will not help, there has to be non-penalising law to deter it. Probably some penalty or heavy amount of alimony as deterrence. Supreme Court may appoint a commission representing equal no of educated men and women from all school of thoughts to come with socially acceptable plan.

The ineffective MPLB is of no help and orders from SC without counting element of haram and halaal will create chaos rather than solution. Social reform is necessary to make legal reform effective. Educate and create consensus among Muslims to shun Triple Talaq.
